The following terms and conditions (the “Agreement”) govern your use of our website, shop-elate.com (the “Site”), and the services available on or through the Site (collectively referred to as the “Service”). The Service is owned and operated by M/s Deva Ecom, represented by Deepali Mittal, and located at C-28, II Floor, RDC, Raj Nagar, Ghaziabad, Uttar Pradesh, India (referred to as "M/s Deva Ecom," "we," "us," or "our"). Your use of the Service is subject to your acceptance without modification of all the terms and conditions contained herein, as well as any other operating rules, policies, and procedures that may be published from time to time on the Site by M/s Deva Ecom. By using the Site, you agree to comply with and be bound by this Agreement. If you do not agree to this Agreement, please do not use the Site.

1. Customers

1.1 By using the Service, you certify that you are at least 18 years of age and legally permitted to use the Service. If you are accessing the Service on behalf of a company or organization, you represent that you have the authority to bind such entity to this Agreement. The Service is void where prohibited by law.

2. Modifications

2.1 M/s Deva Ecom reserves the right to modify this Agreement, fees, charges, and terms at any time. You are responsible for reviewing and becoming familiar with any such modifications. Your continued use of the Service following such modifications constitutes your acceptance of the modified terms and conditions.

3. Responsibility of Site Customers and Visitors

3.1 Violation of any articles of this Agreement or other rules may result in the prohibition of your use of the Site. M/s Deva Ecom reserves the right to limit, suspend, or terminate your access to the Service if you are found to be in violation of this Agreement.

4. Payments and Fees

4.1 By placing an order through the Site, you agree to pay the applicable fees and charges for the Products ordered. M/s Deva Ecom may save your credit or debit card information for future shipments and charges, unless you notify M/s Deva Ecom otherwise. We reserve the right to change the fees for our Products at any time, but will notify you of any changes in advance.

5. Shipping, Returns, and Right of Withdrawal

5.1 Once an order is placed, it cannot canceled. However, if you need to make modifications, please contact us as soon as possible. Replacement of Products or refunds for damaged or undelivered items are subject to investigation and discretion by M/s Deva Ecom.

5.2 If your order has not been printed but production has started, a partial refund may be issued, excluding the cost of digital design. 

5.3 Once an order has been printed, no refunds are possible.

5.4 M/s Deva Ecom will review replacement or refund requests within 14 days of the order being delivered. Refund requests will be processed within 5 working days.

6. Description of Products

6.1 Product descriptions are available on the Site, and we make every effort to accurately represent each design. However, we cannot guarantee that colors and details in website images are 100% accurate representations of the Product. 

7. Purchase of Products

7.1 Your order is considered an offer to purchase a Product, which is accepted by us once we have sent you an order confirmation email. We reserve the right to refuse or cancel any order for any reason.

8. Delivery

8.1 We deliver to customers in the United States, Canada, and Australia. Delivery charges vary depending on location and type of Product. Standard delivery times are provided on the Site, but we cannot guarantee delivery dates.

9. Release

9.1 By using the Service, you release M/s Deva Ecom from any claims or damages arising out of disputes between users or customers.

10. Personal Data and Cookies

10.1 By using the Service, you consent to the use of cookies on the Site and the storage and use of relevant personal data for order fulfillment purposes.

10.2 We may use real customer photos for advertising purposes, unless requested otherwise by the customer.

11. Indemnity

11.1 You agree to indemnify and hold M/s Deva Ecom harmless from any claims or damages arising out of your breach of this Agreement or violation of any law or third-party rights.

12. Law and Jurisdiction

12.1 Any disputes arising from this Agreement will be subject to the laws and jurisdiction of India.

13. General

13.1 This Agreement does not create any agency, partnership, or joint venture between you and M/s Deva Ecom.

13.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
